正当防卫的本质是鼓励民众向不法侵害作斗争。对于正当防卫，今年的“两高”报告均表明态度，明确强调“法不能向不法让步”。让“第二十条”持续落到实处还需要强有力的保障。例如进一步完善保护机制，使社会公众敢于直面不法行为而无后顾之忧，等等。
